INTERPRETATIONS

In these Terms and Conditions, unless expressed to the contrary, the following expressions are defined as follows.

DVLA - Driver and Vehicle Licensing Agency. An executive department of the Ministry of Transport.

DVSA - Driving and Vehicle Standards Agency. An executive department of the Ministry of Transport.

Business – Means Avanti Driving School and any other business associated with Avanti Driving School whether incorporated under the Companies Act 2006 or not.

Pupil/Student - A person receiving Driving Instruction/Tuition from Avanti Driving School.

Consumer As defined by the Consumer Rights Act 2015

Driving Instructor - An approved Driving Instructor (ADI) or Potential Driving Instructor (PDI) Licensed and registered by the DVSA.

Minor Someone who has not yet reached the age when they get full Legal Rights. In the UK, this is a person under 18 years old (See Clause 3.) The British Nationality Act 1981

Parent/Guardian - Means an individual with legal responsibility for the Pupil/Student who will assume legal responsibility for the Students actions or non-actions in accordance with these Terms & Conditions.

Guarantor A person responsible for signing these Terms and Conditions and assumes responsibility for ensuring any monies due for Driving Instruction under these Terms and Conditions are paid.

Lesson A period of instruction given by a Driving Instructor.

Driving Licence. A document issued by DVLA showing a person's entitlement to drive either as a full licence holder or as a learner driver.

Avanti Driving School are members of the ICO (Information Commissioners Office); Certificate Number ZB097876

1. TERMS AND CONDITIONS - These are standard terms and conditions that Avanti Driving School use to carry out Driver Training. Do not agree to these conditions unless you want to be legally bound by them. Failure to agree with the Terms and Conditions means that Avanti Driving School will not be able to carry out any tuition. These Terms and Conditions may be varied from time to time and by continuing with driving lessons is acknowledgement of the Pupils/Students acceptance.

2. JURISDICTION - The courts of England have exclusive jurisdiction to settle any dispute arising out of or in connection with this Agreement (including a dispute regarding the existence, validity or termination of this Agreement) (a “Dispute”). Each Party agrees that the courts of England are the most appropriate and convenient courts to settle Disputes and accordingly no Party will argue to the contrary.

3. MINORS - A minor is defined under UK law as a person under the age of 18. (See Definitions). Any person under the age of 18 who wishes to have Driving Lessons must have a copy of these Terms and Conditions signed by a Parent or Guardian who will then become The Guarantor. They will assume responsibility for paying for the Driving Lessons. If on reaching the age of 18, the Pupil or Student wishes to continue with driving lessons, they must sign and date a copy of these Terms and Conditions. Once signed, the responsibility of the guarantor is ended.

4. LESSONS

4.1 The driving lesson will start at the Pupils/Students home address or other pick up point e.g. school, college, work or an alternative address within an agreeable distance and will finish at your address or drop off point, which has been previously arranged with the Instructor.

4.2 If you have been banned from driving and are training for a retest, You must be legally entitled to take tuition and must present proof to your Instructor of that entitlement.

4.3 Pupils/Students are expected to be aware of traffic laws before they start driving and therefore are responsible for any traffic offences which may occur during lessons, including, but not limited to, speeding or running red lights. You could also be liable for any damage caused by driving recklessly or without due care and attention i.e. tyres, alloys, paintwork etc. The Driving Instructor will do their best to alert the Pupil/Student verbally or use the dual controls fitted in the car. However, in some circumstances it may not be possible for the instructor to do so.

4.4 Pupils are expected to be aware they should have regular lessons, to aid their learning. This should consist of at least one lesson each week. The times and days may vary due to the availability of the Instructor and the Pupil. Duration of each lesson would normally be 1.5 hours (90 mins) this could be longer, subject to availability and agreement between the Instructor and the Pupil.

4.5 If there has been no contact from the pupil, either before their first lesson or 1 calendar month after their previous lesson, they may be removed from our system to comply with GDPR.

4.6 Pupils with a test approaching, will receive priority for any additional lessons. Don't worry, when your test is approaching, you will also be offered priority.

5. REQUIREMENTS

On the Pupil/Students first lesson they must provide:

(a) A valid provisional or full drivers licence. Lessons cannot commence without this documentation.

(b) They may also be asked for their NI number or a code from gov.uk - so the Instructor can check the validity of the driving licence on-line.

5.1 Personal details should be inserted onto your Total Drive profile, such as phone number(s), address, licence details, email and any other information required at that time. For time and accuracy a photo may be taken of the Driving licence or the Pupil/Student may be asked to forward a copy electronically and the details recorded later. All details will be stored securely inline with the ICO and GDPR regulations. and will not be disclosed to any third party, with the exception of booking or moving a driving test date/time with another instructor or if required by a court of law or another legal body. Please ask for further information.

5.2 Before commencement of the first lesson with Avanti Driving School, the Pupil/Student must be able to read (with the aid of glasses or contact lenses if necessary), a standard car registration plate at a distance of 20.5 metres/ 67 feet. (Approximately 5/6 standard car lengths) You will be asked to demonstrate this by your Driving Instructor. Should you not be able to demonstrate this, the lesson will be terminated and the full lesson fee will still be charged.

5.3 Our Driving Instructors have a right to feel safe at work and in public. Any unpleasant, threatening or violent behaviour, will immediately cease any further business and potentially legal action may be taken.

6. VEHICLE FOR TUITION

Each Avanti Driving School Instructor, will ensure the vehicle provided for tuition is clean and presentable, fitted with dual controls and is fully roadworthy, taxed, has a valid MOT (where relevant), and is fully insured for the purposes of driving tuition.

6.1 The Pupil/Student may request to use their own vehicle for tuition. The Driving Instructor will decide at his/her sole discretion whether it would be safe to do so at the time. If it is agreed that your vehicle will be used, you must provide proof to the Instructor of your vehicle’s road worthiness, tax, valid MOT (where relevant) and suitable insurance for the purposes of driving instruction and practical driving test. You must also supply "L"plates and an interior mirror. There may be occasions where the Instructor will request that dual controls be fitted at your own expense, for the safety of yourself and other road users.

6.2 Lessons will still be charged at full rate, if using pupils vehicle.

7. PUNCTUALITY

It is the responsibility of the Pupil/Student to be at the agreed pick-up point on time; if they know they may be delayed, the instructor must be informed as soon as possible. In the event they are late, the lesson would have commenced at the originally agreed time. E.g. if your lesson time is at 10:00 am and you have not attended by 10:01 am, the lesson will be deemed to have commenced. The Instructor will wait for 15 minutes after the commencement of the lesson and if there is no contact or attendance the Instructor will leave marking it down as a “no show”. The Pupil/Student will be charged in full for the ‘no show' lesson, see Clause 9

7.1 Your Driving Instructor will also endeavour to begin at the agreed time and will inform you, where possible, if they are going to be more than 10 minutes late. Please understand that this is not always possible and they may run a little late due to traffic etc. Your lesson time will begin once they arrive and will be for the full duration of time the lesson is booked for.

8. PAYMENT FOR TUITION

The Driving Instructor is self-employed, therefore payments are to be paid directly to them.

Payment is to be made either by the Total Drive app or bank transfer. Cash is only accepted under certain circumstances and must be agreed with the Driving Instructor. Cheques are not accepted.

8.1 Payment for the first lesson is NON REFUNDABLE as it will be considered as an admin fee to add pupil to our system.

8.2 The first lesson is not changeable or transferable.

8.3 Lessons are to be paid at least one week in advance, whether paid by the Total Drive app or bank transfer. You will be required to pay the full lesson price to hold and confirm your place. Payment for the following lesson will be due on booking.

8.4 Failure to make payment for your future lesson may result in Total Drive removing such future booked lesson without notice to you. If this becomes a regular occurrence, you may be removed entirely from Total Drive and indeed lose any space in the future.

8.5 If receipt is required for payment please ensure your Total Drive profile has an email address. your Instructor, will be happy to assist you. Bank transfer will also act as an electronic receipt for payment.

8.6 Driving lesson fees are subject to increase from time to time; a minimum of 1 (one) calendar months' notice will be given prior to the change. Any prepaid lessons will be honoured at the price purchased; no additional fees will be added. We will try not to increase lesson prices until your first driving test or 1 year, whichever comes first. Thereafter the current pricing comes into affect.

8.7 If Block Bookings are offered, please note that they are at a discounted rate and therefore are NON REFUNDABLE & NON TRANSFERABLE at anytime. They must be used within 3 months of purchase and only be used for lessons, and not towards test costs.

8.8 Any promotions or Block Bookings may be withdrawn at any time without reason.

8.9 Any monies received, must be used within 3 calendar months. After 3 calendar months, monies/credit will not be refunded nor transferred. (see clause 10.2)

9. LESSON CANCELLATIONS

If the Pupil/Student wishes to cancel a lesson, at least 3 (three) clear working days (72 hrs) notice is required (this DOES NOT include Weekends or Public Holidays). Any cancellations giving less than 72 hrs notice will be subject to the full lesson being payable/charged.

9.1 Should the Instructor have to cancel the Driving Lesson at short notice, for whatever reason, it will not affect your statutory rights, and any monies paid for the lesson will not be subject to forfeiture.

9.2 If during the course of a lesson or immediately prior to the commencement of a lesson, the Pupil/Student advises the Instructor they will not be able to complete the lesson in full, then the full cost of the time booked will be charged.

10. REFUNDS

Should the Pupil/Student wish at any time to discontinue lessons that have been prepaid to the Instructor at full price and subject to the terms in Clause 9, a refund representing unused hours that have been prepaid will be returned via Bank Transfer only. Any booking fees will not be refunded by Avanti Driving School as we do not receive those funds.

10.1 Should the Pupil/Student have a test booked before all the prepaid hours have been used then any remaining hours after the test costs have been deducted will not be refunded nor are transferable.

10.2 Any monies received, must be used within 3 (three) calendar months from the payment date. Any monies will be NON REFUNDABLE nor transferable, once 3 calendar months has been reached. Avanti Driving School shall not be held liable to inform you of any potential refunds. (see clause 8.9)

11. THEORY AND PRACTICAL DRIVING TEST

The Student will need to have passed their theory test before a practical test can be booked. If help is required with the theory-test then let the Driving Instructor know and they will do their best to help where possible. They will also be able to advise/help on how to book your theory test. Avanti Driving School "may" also offer their current students a FREE Theory test App.

11.1 Avanti Driving School will try to book the student’s practical test. A fee for the test and the use of the instructor's car will be charged, the fee includes the DVSA test fee, being picked up before the test time in accordance with the terms in clause 4.1. The fee will need to be paid at least four weeks before the test date. Failure to pay before this time, unless otherwise arranged with your Driving Instructor, could result in the test being cancelled. A new test will be arranged once payment is received.

11.2 All test fees are subject to change, by the DVSA and Avanti Driving School. You will be advised beforehand, before any tests are booked. If the Pupil/Student has already purchased/paid for a test, then the test fee may be deducted from the fee charged for the test day.

11.3 The Pupil/Student will be informed by the Driving Instructor once He/She feels they are ready for the Practical Driving Test and if necessary arrange for the booking of the test in accordance with Clause 11.1.

11.4 Tests purchased by Avanti Driving School are to be used for our pupils. We do NOT charge any admin or booking fees to obtain a driving test for our pupils.

11.5 Should the Pupil/Student book the Practical Driving Test, contrary to the advice of the Driving Instructor, neither the Driving Instructor or the Driving Instruction car will be made available to the Pupil/Student for the Driving Test.

12. DISCLOSURE

Before taking any lessons, it in the interest of the Pupil/Student to disclose any learning difficulties or disabilities, physical or otherwise which could affect the way they learn and/or their ability to drive (e.g. ADD (ADHD), ASD, dyslexia, dyspraxia, deafness or any other additional needs etc.) This could help the Instructor tailor the lesson for the needs of the pupil. There may also be alternative adaptations available which could be fitted/used to aid learning.

12.1 It is important the Pupil/Student discloses to the Driving Instructor, any health issues they have and any medication they are currently prescribed. The Driving Instructor will discuss this with you as well as how the medication may affect the ability to drive.

13. DECLARATION

I declare that I am not undergoing court prosecution for the removal of my driving licence, that the current licence produced is legal and I am not currently disqualified from driving or have any endorsement/ points pending. I will bring my licence with me each lesson.

13.1 I am also aware that it is illegal to drive whilst under the influence of drugs or alcohol and understand that there is a zero-tolerance rule whilst under the instruction of Avanti Driving School to be under the influence of Drugs and/or Alcohol. Should the Instructor, at any time suspect that I, the Pupil, am under the influence of drugs, alcohol or any other substances which could impair My driving ability in any way, the lesson will be terminated and I will still be charged for the lesson in full & any future lessons will be terminated.

13.2 I, the pupil, agree to inform the Instructor of any change of circumstances, health, medication, address, telephone number or driving licence details etc. It is also my responsibility as the Pupil to make sure My licence details are correct and up to date and renewed when applicable.

13.3 By signing this document I give permission to Avanti Driving School to keep this document and my details on file, for as long as is necessary.

14. ACCEPTANCE

By electronically signing this document, you are agreeing and confirming that you are 18 years of age or over, or the Guarantor for the Pupil/Student and have read, understood and agree to be bound by the Terms and Conditions within this document.

12. DISCLOSURE

Before taking any lessons, it in the interest of the Pupil/Student to disclose any learning difficulties or disabilities, physical or otherwise which could affect the way they learn and/or their ability to drive (e.g. ADD (ADHD), ASD, dyslexia, dyspraxia, deafness or any other additional needs etc.) This could help the Instructor tailor the lesson for the needs of the pupil. There may also be alternative adaptations available which could be fitted/used to aid learning.

12.1 It is important the Pupil/Student discloses to the Driving Instructor, any health issues they have and any medication they are currently prescribed. The Driving Instructor will discuss this with you as well as how the medication may affect the ability to drive.

13. DECLARATION

I declare that I am not undergoing court prosecution for the removal of my driving licence, that the current licence produced is legal and I am not currently disqualified from driving or have any endorsement/ points pending. I will bring my licence with me each lesson.

13.1 I am also aware that it is illegal to drive whilst under the influence of drugs or alcohol and understand that there is a zero-tolerance rule whilst under the instruction of Avanti Driving School to be under the influence of Drugs and/or Alcohol. Should the Instructor, at any time suspect that I, the Pupil, am under the influence of drugs, alcohol or any other substances which could impair My driving ability in any way, the lesson will be terminated and I will still be charged for the lesson in full & any future lessons will be terminated.

13.2 I, the pupil, agree to inform the Instructor of any change of circumstances, health, medication, address, telephone number or driving licence details etc. It is also my responsibility as the Pupil to make sure My licence details are correct and up to date and renewed when applicable.

13.3 By signing this document I give permission to Avanti Driving School to keep this document and my details on file, for as long as is necessary.

14. ACCEPTANCE

By electronically signing this document, you are agreeing and confirming that you are 18 years of age or over, or the Guarantor for the Pupil/Student and have read, understood and agree to be bound by the Terms and Conditions within this document.
